WARNING CEASE AND DESIST - IS THIS A SCAM?


I JUST REC'D THIS --- DOES ANYONE KNOW ANYTHING ABOUT THIS? IS IT GENUINE

Warning you are in violation of Section HR.315 of the Fairness Doctrine Imposed by the Federal Communications Commission (1949) we ask that you cease operations and shut down immediately or else further Legal action will be committed towards your site and or you.  Agent Johnson [Johnson@undislosed.com]

In my opinion, it is another hoax. I do not believe the FCC would send notices by way of email. They are a lot of things, but stupid is not one. Just do not click on links or anything if you are running Windows operating systems. Could be malware.

As an aside, part of the ruling could be construed as justifying Congressional or FCC intervention in the market to limit monopolization, although the ruling is addressing the abridgment of freedom:

It is the purpose of the First Amendment to preserve an uninhibited marketplace of ideas in which truth will ultimately prevail, rather than to countenance monopolization of that market, whether it be by the government itself or a private licensee. It is the right of the public to receive suitable access to social, political, esthetic, moral and other ideas and experiences which is crucial here. That right may not constitutionally be abridged either by Congress or by the FCC.

It's a scam John think nothing of it. If it where real you would not have got a Cease & Desist email. your site would have been seized by them without warning and anyone trying to access the site would have been redirected to one informing them the site was seized.

"The Fairness Doctrine" has two basic elements to be followed: It "required BROADCASTERS to devote some of their AIRTIME to discussing controversial matters of public interest, and to air contrasting views regarding those matters. STATIONS were given wide latitude as to how to provide contrasting views: It could be done through news segments, public affairs shows, or editorials. The doctrine did not require equal time for opposing views but required that contrasting viewpoints be presented. [2]. The main agenda for the doctrine was to ensure that viewers were exposed to a diversity of viewpoints." Sounds to me like the NESARAnews.blogspot abides by those requirements to the letter. John, not to worry. HR stands for House Resolution, which means it is a (possible) bill that originated in the House of Representatives. As you know, in order for a bill to become law, it must also pass the Senate and be signed by the President. Anything listed as H.R. is merely a potential law, but is not law... yet. So I believe this is a scam. For any charge to be legit, it would have to list an actual statute or code section that clearly made you liable for whatever was being charged.

Also, my feeling is that if you are being charged or warned against a future charge, it would be via a notice in writing and not done via email or on your blog. Ignore this.

According to wikipedia: "The FCC decided to eliminate the Doctrine in 1987, and in August 2011 the FCC formally removed the language that implemented the Doctrine." So it's no longer in force. The wiki page was last updated on 4-26-2013, and it's unlikely that anything new has happened with this in the past couple of weeks.

It was deemed unconstitutional (i.e. violation of free speech) because there are now plenty of available "choices" and opposing views to listen to, especially with the advent of the internet. For more info, you should read the entire wiki article; it's pretty interesting.

Also, the FCC's policies are codified in section 47 of the CFR (Code of Federal Regulations). The specific sections that were removed were 47 C.F.R.
73.1910 (broadcast rule), and 47 C.F.R. 76.209 (cablecast rule). Additionally, 47 C.F.R. 76.1612 and 76.1613 (personal attack and political editorial rules) were also removed, but these probably wouldn't affect you. The official FCC communication regarding this is at: www.fcc.gov/document/fcc-eliminates-out-dated-media-related-rules (dated 8-24-2011).

Of course, the "Fairness Doctrine" policies have now been removed, but the reference to "HR.315" (used by whomever sent you that letter) is not standard terminology used when referring to sections of the Code. So that also makes that letter highly suspect.

Probably someone is either playing a prank on you, or they were trying to scam you into shutting down your site. Did they send it via postal mail (is there an official letterhead), or was it via e-mail? You should post a picture of the 'request' online, in case they're trying to scam other people as well.

I received something like this years ago. Check your computer for a virus. The virus I received was pretty nasty. It even made it real tough get into system restore in safe mode.

First, the Fairness Doctrine is not in effect anymore. I speak as a broadcaster of many years. The Fairness Doctrine was put into effect to force broadcasters to grant time to opposing viewpoints. Reagan did away with the doctrine when he deregulated the industry. It has been feared that Obama might try to bring it back to neutralize conservative talk radio hosts like Limbaugh, etc., but he hasn't even tried. I doubt he could get it through Congress, because the broadcaster lobby is very powerful in Washington. So don't worry about the email....it's a scam. Besides the Fairness Doctrine even if it were in effect, would never be used to force someone to cease and desist. That would be left up to the full body of the FCC. And even then it would only apply to licensees of Radio and TV stations----which you are not. Sleep well.........

John - Maybe the dems and Obama don't like some of the posts about them. I have heard that if anyone sends e-mails and posts anything anti about O then he will try to shut you down. He's getting his Fema camps ready for all of us.............

Have you ever known anyone who is on such a big ego trip along with being a control freak. Pay no mind to the Cease business - someone disagrees with you and wants you to shut up - don't do it - free speech still exists in our country.

Nesara-Republic Restored as a NON-LICENSED personal opinion publishing blog venture would not fall under the jurisdiction of any FCC rules, regulations, or policies even if the policy was still being looked into by the corporate division of controled and approved communications, the FCC (not a federal dept).
The hidden controllers sought to control all permisable avenues to inform the American public of important concepts for thoughtful consideration by attempting to enforce a policy that always included their distorted viewpoint to insure public confusion and public disarray which favored delay and inaction against the advancing agendas of the USA corporation against the American people by using a percieved branch of governance to intimidate and cower any that opposed the movement not favored by the hidden controllers.
